CONTEST RULES:
1.Introduction: Welcome to the Official Rules ("Rules") governing participation in the "LPBurst" Promotion. All submissions to and participation in the Promotion will be in accordance with these Rules. By entering the Promotion, you agree to be bound fully and unconditionally by each of these Rules as well by as the decisions of Gibson, as the Sponsor of the Promotion, regarding their interpretation and the operation of the Promotion. Gibson reserves the right to modify these Rules in its sole discretion for any purpose without materially affecting the terms and conditions of the Promotion.
2. Eligibility: Employees and production personnel and their immediate family members, which includes anyone living in the same household as employees and production personnel of Gibson Guitars, their advertising and promotion agencies, and their subsidiaries, divisions, affiliates and related companies, are not eligible to participate or win.
3. Sponsor: Come on, who else would sponsor a contest this cool except Gibson Guitar Corp., 309 Plus Park Blvd., Nashville, TN 37217.
4. The "LPBurst" Promotion Format: The "LPBurst" Promotion consists of opting in by texting LPBURST to 85700. By doing so, you will enter your cell phone number into a random drawing for a free Gibson guitar.
5. Entry Methods: If you have a text messaging-capable cell phone from participating Wireless Carriers (Verizon, Sprint, Nextel, Boost, AT&T, T-Mobile, Dobson, Alltel), you can enter the Promotion by sending a text message, containing the key word "LPBURST" to the shortcode (85700).
Depending on the type of service you have, your phone company may assess text-messaging charges in connection with attempted entries and corresponding error messages even if your attempted entry does not go through because of connectivity or other problems. You may opt out of participating further via text messaging by texting "STOP," "QUIT" or "END" in response to a message received in connection with the Promotion. By sending your entry text messaging, you consent to a call back from Gibson or one of its agents or representatives at any time.
PLEASE NOTE THAT A HIGH VOLUME OF ENTRIES BY TEXT MESSAGING, OR TECHNICAL DIFFICULTIES WITH THE SYSTEM, MAY RESULT IN TEMPORARY INABILITY TO ENTER THE "LPBURST" PROMOTION OR A DELAY IN THE PROCESSING OF ENTRIES SO THAT YOUR ENTRY IS NOT RECEIVED IN TIME TO PARTICIPATE. GIBSON IS NOT RESPONSIBLE OR LIABLE SHOULD ANY ENTRY NOT BE RECEIVED DUE TO SUCH DELAYS. So, the best course of action is not to wait until the last minute to enter, just in case!
6. Selection of Winners: Gibson has hired an independent company to pick a winner, chosen at random from all entries received via the LPBURST keyword or by telephone at the number provided. By entering, you agree that, if you are declared an Official Winner, Gibson may use your name, home city, image, voice, biographical information and statements, to announce you as the winner as well as for any reasonable commercial or promotional purpose in any media form or forum, without any additional compensation. Your chance of winning will depend upon the number of people who enter the contest.
In the event the LPBurst operator is unable to contact you for any reason at the telephone number you provided when you entered (including but not limited to busy phone line, "number not known" message or answer machine message received,) after five (5) attempts, you will forfeit your position as Official Winner and another lucky entrant will be randomly selected. In the event of a dispute as to the identity of any Official Winner, the winning entry in question will be deemed submitted by the authorized account holder of the cellular phone or telephone number used to enter. "Authorized account holder" of a cellular phone is the natural person in whose name the phone has been issued and to whom services are billed. "Authorized account holder" of a telephone number is defined as the person who is legally responsible for the payment of the bill for the telephone line. If a dispute cannot be resolved to Gibson's satisfaction, the entry in question will be deemed ineligible, and a new winner will be randomly selected.
7. Prize: The winner will receive a Gibson guitar, model to be chosen by Gibson in its sole discretion.
8. Participation and Validation of Entries: LIMIT: One (1) entry per person. Entries generated by a script, macro or other automated means will be disqualified. USE OF COMPUTER PROGRAMS TO ENTER AND/OR OTHER AUTOMATIC ENTRY METHODS, (SUCH AS HACKS OR BOTS), REGARDLESS OF METHOD OF ENTRY, IS STRICTLY PROHIBITED. Gibson reserves the right to disqualify, block or discard any entries from any individual who enters by any kind of electronic, mechanical or other automated means or otherwise tampers with or hacks the entry process as determined by the Gibson in its sole discretion. Gibson also reserves the right, in its sole discretion, to cancel, modify or suspend the Internet, electronic and/or text-messaging portions of the Promotion in the event of a computer virus, bugs, tampering, unauthorized intervention, fraud, technical or system failure or disruption, force major or any other cause which, in its opinion, corrupts the administration, security, fairness, integrity, or proper operation of the Promotion. In addition, Gibson will prosecute to the fullest extent under all applicable laws any person or persons attempting to or actually causing damage to any website relating to the Promotion or undermining the operation of the Promotion. If it is discovered that any Official Winner used any of the above devices or methods during the Promotion, Gibson has the right to: (i) withhold award of the prize, or (ii) if prize has already been awarded, demand return of the prize from such Winner. Gibson reserves the right to use the technical logs and computer records of Gibson or its agents or representatives to determine whether a Winner qualifies for award of the prize.
9. Winner Verification: If you win, you must sign (i) an affidavit of eligibility confirming that you played by these rules, (ii) a release of liability, (iii) a W-9 if requested; and (iv) where permitted a publicity release, all within ten (10) calendar days of notification that you were selected. You will also be required to provide proof of identity, age and ownership of the phone number you used used to enter the Promotion. If you are 18 years of age or older, but the state you live in considers you a minor until you hit a later age, your prize will be awarded in the name of your parent or legal guardian, so be very nice to them. You are responsible for all taxes on the prize, but, hey, you just got a Gibson, so it is worth it!
10. The Language Our Lawyers Make Us Put In: You enter and play at your own risk. Gibson and its respective officers, directors, employees parents, subsidiaries and affiliates are not responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, incorrect, incomplete, ineligible or unintelligible entries; (ii) telephone, electronic, hardware, software program, network, Internet or computer failures or difficulties; (iii) errors in transmission, computer systems, telephone lines, hardware or software malfunctions, or other errors, failures, dropped computer connections that are human and/or technical in nature; (iv) any condition caused by events beyond Gibson's control that may cause the Promotion to be disrupted or corrupted; (v) any injuries, losses, or damages of any kind caused by a prize or resulting from acceptance, possession, use or misuse of a prize, or from participation in the Promotion or any damage to your computer system or wireless telephone (or anyone else’s you may have used) that is directly or indirectly caused by accessing the website or text messaging application or otherwise participating in the Promotion; or (vi) any printing or typographical error in any materials associated with these official Rules or the Promotion generally. Gibson and their respective officers, directors, employees, parents, subsidiaries and affiliates assume no responsibility for any injury or damage to participants or to any other person's computer relating to or resulting from entering or downloading materials or software in connection with this Promotion. Without limiting the foregoing, Gibson is not responsible for incomplete, illegible, misdirected, late, lost, damaged, stolen entries; or for lost, interrupted, inaccessible or unavailable networks, servers, satellites, ISP's, websites, wireless providers, text applications or other connections; for miscommunications, failed, jumbled, scrambled, delayed or misdirected computer, telephone or cable transmissions; or for technical malfunctions, failures or difficulties, printing errors, clerical, typographical or other errors of any kind or nature; or for the incorrect or inaccurate capture of information. By entering this Promotion, you agree that you are assuming all liability for any injury or damages caused or claimed to be caused by his or her participation in the Promotion and/or the acceptance and/or use of any prize, and you release Gibson and its respective officers, directors, employees, parents, subsidiaries and affiliates from any such liability.

Except where prohibited by law, you agree that this Promotion and its Rules shall be construed and governed by the laws of the State of Tennessee and: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by state or federal courts situated in Nashville, Tennessee (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys' fees, costs or expenses; and (3) no punitive, incidental, special, consequential or other damages, including without limitation lost profits may be awarded and (4) you on your own behalf and on behalf of your heirs, representatives and assigns hereby waive all rights to claim Special Damages and all rights to have such damages multiplied or increased.
